Agreement and seller

These Terms govern orthotruss.com and OrthoTruss software, simulators, guides, and connected services (the “Services”). The Services are operated by Jean-Marc E. Choufani under the OrthoTruss brand, 701 Buckskin Dr, Round Rock, TX 78681. By purchasing, activating, or using a Service, you agree to these Terms and the Privacy Policy. Paid Services are offered only in the United States to users age 18 or older for professional or business use.

Educational & research tools

The OrthoTruss™ biomechanics simulators, calculators, and related software (the "Tools") are provided for education, training, and research. They illustrate general biomechanical and material-science principles using transparent, published equations. Every output is intended to help users understand and study the underlying physics.

Not a medical device

The Tools are not a medical device and are not intended to acquire, process, or analyze any individual patient's medical images, signals, records, or other patient-specific data. They do not diagnose any condition, recommend any treatment, or generate any patient-specific output. They operate only on generic parameters entered by the user (for example, a wire dimension, a force magnitude, or a root geometry). Nothing produced by the Tools should be relied upon as clinical advice for a specific person.

Professional responsibility

The diagnosis and treatment of patients require the independent judgment of a qualified, licensed healthcare professional who has examined the patient. The Tools do not replace clinical examination, professional judgment, or established standards of care. Any clinical decision is the sole responsibility of the treating professional.

Accuracy & limitations

While the models are validated against published literature and disclose their governing equations and assumptions, all simulations are simplifications of reality. Results may not reflect any particular clinical situation. The Tools are provided "as is," without warranty of any kind, express or implied, including fitness for a particular purpose.

Practice Pioneer — additional terms

The following terms apply specifically to the OrthoTruss™ Practice Pioneer desktop application ("Pioneer") and supplement the general terms above.

Planning tool — not professional advice

Pioneer is planning and organization software. It is not a franchise, business opportunity, income program, or promise of profit, savings, financing, licensing, credentialing, compliance, or practice success. Outputs—including cash-flow scenarios, budget estimates, lender-package drafts, market analyses, lease flags, checklists, timelines, and AI responses—depend on assumptions and may be incomplete, inaccurate, or outdated. They are not legal, tax, accounting, investment, lending, real-estate, insurance, regulatory, or clinical advice. Verify material decisions with qualified advisers and primary sources.

Purchases & refund policy

Practice Pioneer Pro is a one-time purchase. You may request a refund within seven calendar days after purchase by emailing licenses@orthotruss.com. Approved refunds return the amount paid to the original payment method and suspend the associated paid license. After seven days, payments are non-refundable except where required by law or approved to correct a billing error.

License scope

A Pro license is for one user and one active machine at a time. You may use the available transfer process when replacing a machine. A one-time purchase permits continued local use of the purchased major version; it does not promise perpetual updates, support, hosted AI, third-party data, or other network services.

AI-generated content

Hosted AI is an optional Pro feature, uses Anthropic, and is subject to reasonable usage limits and provider availability. AI-generated content may be inaccurate, incomplete, outdated, or non-unique. Do not submit PHI and do not rely on AI output as a substitute for professional review.

Optional Practice OS subscription

Practice OS is separate and optional. Its price and billing interval are shown before checkout, and it renews automatically until canceled. Cancellation through the available billing-management process takes effect at the end of the current paid billing period. Fees already paid are not prorated or refunded except where required by law or approved for a billing error. Any change to the subscription price applies only to a future billing period after advance notice. Pioneer Pro continues to work without Practice OS, although subscription-only network services stop when the paid period ends.

Privacy & data

Do not enter protected health information into Practice Pioneer, public simulators, support requests, or hosted AI. Those Services are not clinical record systems, and OrthoTruss does not offer a HIPAA business associate agreement for them. Intellectual property & trademarks

OrthoTruss™ is a trademark of Jean-Marc E. Choufani. All software, content, branding, the OrthoTruss™ name, and the OrthoTruss™ logo are proprietary and owned exclusively by Jean-Marc E. Choufani. Unauthorized use of the OrthoTruss™ name or logo in connection with any software, service, or healthcare product is prohibited.

The underlying biomechanics engine is proprietary. The research library is made available under a source-available, citation-required license; research use that relies on the engine must cite it as specified in that license. Commercial and clinical-practice use of the library requires a separate license.

Acceptable use and suspension

You are responsible for your entries, decisions, credentials, recovery information, exports, and backups. You may not resell or share license keys, bypass access controls, scrape hosted services, introduce malicious code, violate law or third-party rights, or evade usage limits. Paid or hosted access may be suspended for a refund, chargeback, material breach, fraud, abuse, security risk, or unlawful use.

Warranty disclaimer

To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or results. Nothing excludes a right that applicable law does not allow to be excluded.

Limitation of liability

To the maximum extent permitted by law, Jean-Marc E. Choufani and OrthoTruss will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, data, opportunities, or goodwill; or decisions made from Service outputs. Aggregate liability arising from a paid product will not exceed the amount paid for the product giving rise to the claim. Aggregate liability arising solely from a free product will not exceed US $100. These limits do not apply where prohibited by law.

Disputes and governing law

Before filing a claim, email a written description to licenses@orthotruss.com and allow 30 days for informal resolution. Texas law governs these Terms. An unresolved claim may be brought in an eligible small-claims court or a state or federal court located in Williamson County, Texas. No mandatory arbitration provision applies.

Changes and complete agreement

Material changes will be identified by a new effective date and presented for renewed acceptance when required. If one provision is unenforceable, the rest remains effective. These Terms and incorporated policies replace inconsistent prior statements about the Services.
